This Community Guidelines and Code of Conduct (“Guidelines”) are issued by Lahar Networks Private Limited, a company incorporated under the Companies Act, 2013, bearing CIN U63112DL2025PTC452796, having its registered office at D-365, West Vinod Nagar, East Delhi, Delhi 110092, India. These Guidelines apply to all users of the Lahar platform (“Lahar”, “Platform”), including Regular Users, Content Creators or Marketplace Operators, and Institutional Users. By accessing or using the Platform, you agree to abide by these Guidelines in addition to the Terms of Service and Privacy Policy.
1. Purpose
1.1 The purpose of these Guidelines is to define acceptable standards of content and behavior on the Platform.
1.2 These Guidelines are intended to protect Users, foster a safe and respectful community, and ensure compliance with applicable laws, including the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Digital Personal Data Protection Act, 2023, and other relevant global regulations.
2. Applicability
2.1 These Guidelines apply equally to all categories of Users, namely Regular Users, Content Creators or Marketplace Operators, and Institutional Users.
2.2 Institutional Users, including governments, corporations, and institutions, shall ensure that their Super Admins, Admins, and Users comply with these Guidelines.
3. Acceptable Use
3.1 Users may post, share, and engage with content that is lawful, respectful, and appropriate for a global audience.
3.2 Users shall exercise responsibility when publishing opinions, reviews, or information, ensuring accuracy and honesty.
3.3 Content monetized or distributed through the Platform’s Marketplace must comply with applicable consumer protection, e-commerce, and financial regulations.
4. Prohibited Content
4.1 Users shall not upload, share, or distribute content that is unlawful, defamatory, obscene, pornographic, invasive of privacy, hateful, racially or ethnically offensive, or otherwise objectionable.
4.2 Users shall not post content that promotes or incites violence, terrorism, self-harm, harassment, or abuse of individuals or groups.
4.3 Users shall not post nudity, sexually explicit content, or sexually exploitative material, including child sexual abuse material (CSAM), which is strictly prohibited under law.
4.4 Users shall not share misinformation, disinformation, or deceptive content intended to mislead or cause harm to individuals, society, or national security.
4.5 Users shall not post content infringing intellectual property rights, including unauthorized use of copyrighted works, trademarks, or trade secrets.
5. Prohibited Conduct
5.1 Users shall not impersonate any person or institution or misrepresent their affiliation with any individual or entity.
5.2 Users shall not engage in harassment, bullying, threats, intimidation, or hate speech directed at any individual or group.
5.3 Users shall not promote discrimination based on race, religion, caste, ethnicity, gender, sexual orientation, nationality, disability, or political beliefs.
5.4 Users shall not engage in fraudulent activity, including scams, phishing, impersonation, or manipulation of the Maker–Checker system.
5.5 Users shall not use the Platform to promote or sell illegal goods or services, including drugs, weapons, counterfeit products, or human trafficking.
5.6 Users shall not interfere with or disrupt the functioning of the Platform, including attempts to hack, reverse-engineer, introduce malware, or engage in denial-of-service attacks.
6. Content Moderation and Takedown
6.1 Lahar reserves the right to remove or restrict content that violates these Guidelines, the Terms of Service, or applicable laws.
6.2 Content may be removed proactively by Lahar or upon receipt of a valid complaint from Users, regulators, or law enforcement agencies.
6.3 Under the IT Rules, 2021, Lahar is obligated to remove or disable access to unlawful content within the timelines prescribed, including within 24 hours of receiving notice in cases involving sexual content, nudity, or child sexual abuse material.
6.4 Users whose content is removed shall be notified, unless such notification is prohibited by law or regulatory direction.
7. Reporting Violations
7.1 Users may report violations of these Guidelines through the reporting tools on the Platform or by contacting the designated Grievance Officer.
7.2 Reports must include sufficient information and evidence to allow Lahar to investigate effectively.
7.3 Malicious or false reporting intended to harass other Users may itself constitute a violation of these Guidelines.
8. Consequences of Violation
8.1 Violations of these Guidelines may result in warnings, content removal, suspension, or permanent termination of accounts.
8.2 Lahar reserves the right to withhold settlements, block monetization, or disable Marketplace access for Content Creators and Institutional Users found in violation.
8.3 Lahar may report violations to law enforcement authorities and share necessary information where legally required.
9. User Responsibility
9.1 Users remain solely responsible for the content they post, transmit, or distribute on the Platform.
9.2 Users are responsible for ensuring that their conduct complies with all applicable laws in their jurisdiction as well as the laws of India.
9.3 Institutional Users shall be responsible for the actions of their designated Super Admins, Admins, and Users under their accounts.
10. Global Compliance
10.1 Users outside India must ensure compliance with applicable local laws, including GDPR, CCPA, COPPA, and other privacy and content standards.
10.2 In case of conflict between local laws and these Guidelines, the stricter standard shall apply, unless otherwise prohibited by law.
