Terms of Service / Terms of Use
Effective Date: 6th August 2025
This Terms of Service Agreement (“Agreement” or “Terms”) is entered into between:
Lahar Networks Private Limited, a company incorporated under the Companies Act, 2013, bearing CIN U63112DL2025PTC452796, having its registered office at:

(hereinafter
referred to as “Company”, “Lahar”, “we”, “our”, or
“us”)
AND
The individual or entity accessing or using the services provided under the brand name “Lahar” (hereinafter referred to as “User”, “you”, or “your”).
By creating an account, accessing, or using Lahar (“Platform”), you agree to be legally bound by this Agreement. If you do not agree, you must not use the Platform.
1. Definitions
1.1 Regular User: Individual or brand account that does not seek monetization. Managed solely by the User.
1.2 Content Creator / Marketplace Operator: Users who monetize through subscriptions or sale of goods and services. These accounts are managed through a Maker–Checker system and are subject to an annual fee.
1.3 Institutional User: Governments, corporations, or institutions, optionally managed by a Super Admin, Admins, and Users with a Maker–Checker system at each level. Subject to annual fees.
1.4 Maker–Checker System: A control mechanism requiring one User (Maker) to initiate actions and another User (Checker) to approve them before execution.
1.5 Services: All features, applications, APIs, and offerings provided by Lahar.
1.6 Applicable Laws: All laws, rules, regulations, directives, notifications, and guidelines of India (including but not limited to DPDP Act 2023, IT Act 2000, Consumer Protection Act 2019, CERT-In Directions 2022) and relevant foreign laws (GDPR, CCPA, COPPA, UK GDPR, etc.) where applicable to the User.
2. Eligibility
2.1 Users must be 18 years of age or the age of majority in their jurisdiction to register for an account.
2.2 Minors:
Users below 18 years may use the Platform only with verifiable parental or guardian consent, as per applicable laws (DPDP Act 2023, COPPA, GDPR, etc.).
The parent/guardian shall be deemed the contracting party and shall bear responsibility for the minor’s use.
2.3 By registering, you represent that you are legally competent to enter into this Agreement. If you act on behalf of an entity, you represent that you are duly authorized to bind that entity.
3. User Categories and Account Management
3.1 Regular Users:
Free of charge.
Managed solely by the User.
3.2 Content Creators / Marketplace Operators:
Subject to an annual fee (non-refundable except as required by law).
Must operate under Maker–Checker system.
Responsible for compliance with applicable tax, consumer protection, and e-commerce laws.
3.3 Institutional Users:
Subject to an annual fee.
May designate Super Admins, Admins, and Users.
Must implement Maker–Checker at each level.
3.4 Account Responsibility:
You are solely responsible for maintaining the confidentiality of your login credentials.
Any activity under your account will be deemed authorized by you.
3.5 Non-Transferability: Accounts are personal or entity-specific and may not be sold, transferred, or assigned without written consent of Lahar.
4. Payments, Fees, and Settlement
4.1 Subscription Fees: Content Creator and Institutional accounts are subject to annual fees payable in advance.
4.2 Marketplace Transactions:
Transactions are processed through integrated payment systems in compliance with merchant acquiring and card network rules.
Users authorize Lahar and its payment partners to deduct applicable fees, charges, taxes, and penalties.
4.3 Chargebacks and Refunds:
Users shall be liable for chargebacks, reversals, and disputes initiated by buyers or payment partners.
Lahar reserves the right to recover such amounts from future settlements or by direct debit.
4.4 Fraud and Risk Monitoring:
Lahar may delay, withhold, or reverse settlements in cases of suspected fraud, illegal activity, regulatory action, or excessive chargebacks.
Users agree to cooperate with investigations.
4.5 Taxes: Users are responsible for reporting and paying all applicable taxes on their earnings.
5. User Rights and Content
5.1 License to Use: Users are granted a limited, revocable, non-exclusive license to access and use the Platform.
5.2 Content Ownership:
Users retain ownership of their content.
By posting, Users grant Lahar a worldwide, royalty-free, non-exclusive license to host, display, and distribute such content solely for Platform operations.
5.3 Content Standards: Users agree not to post content that is unlawful, defamatory, obscene, hateful, or otherwise objectionable under Applicable Laws.
6. Prohibited Activities
Users shall not:
Use the Platform for unlawful, fraudulent, or harmful activities.
Engage in money laundering, terrorism financing, or sale of prohibited goods/services.
Circumvent Maker–Checker, KYC, or AML obligations.
Introduce malware, bots, or engage in denial-of-service attacks.
Misrepresent identity or impersonate another person/entity.
7. Intellectual Property
7.1 Platform IP: All software, source code, trademarks, and content developed by Lahar remain the sole property of Lahar Networks Private Limited.
7.2 User Content IP: Users retain their own content IP but grant Lahar limited license as per Clause 5.2.
7.3 Unauthorized use, reproduction, or reverse-engineering is strictly prohibited.
8. Data Protection and Privacy
8.1 Lahar shall comply with the DPDP Act, 2023, the IT Act, 2000, and rules framed thereunder.
8.2 For international users, Lahar shall comply with applicable laws including GDPR, CCPA, COPPA, UK GDPR, Singapore PDPA, PIPEDA (Canada), etc.
8.3 Users consent to the processing, storage, and transfer of their personal data in accordance with applicable law and our Privacy Policy.
9. Risk Monitoring, Audits, and Compliance
9.1 Lahar may monitor transactions and user activities for compliance and fraud detection.
9.2 Users authorize Lahar to conduct audits, require reports, or suspend accounts pending investigation.
9.3 Users must cooperate with regulators, law enforcement, and payment partners when required.
10. Suspension and Termination
10.1 Lahar may suspend or terminate accounts immediately if:
You violate these Terms;
You engage in fraud, illegal activities, or non-compliance with laws;
Required by regulators, law enforcement, or payment networks.
10.2 Users may terminate accounts at any time. Fees already paid are non-refundable.
11. Disclaimers and Limitation of Liability
11.1 The Platform is provided “as is” and “as available.”
11.2 Lahar does not guarantee uninterrupted access, accuracy, or error-free operation.
11.3 To the maximum extent permitted by law, Lahar’s liability shall not exceed the total amount paid by the User in the 12 months preceding the claim.
11.4 Lahar shall not be liable for indirect, consequential, punitive, or incidental damages.
12. Indemnification
Users agree to indemnify and hold harmless Lahar, its affiliates, officers, employees, and agents against any claims, fines, penalties, or expenses arising from:
Violation of these Terms;
Breach of Applicable Laws;
Fraudulent, negligent, or unlawful acts.
13. Governing Law and Dispute Resolution
13.1 This Agreement shall be governed by and construed in accordance with the laws of India.
13.2 Courts in New Delhi, India shall have exclusive jurisdiction over disputes.
13.3 For Users outside India, Indian law shall apply unless mandatory provisions of local consumer law override.
14. Amendments
We may revise these Terms periodically. Continued use after publication constitutes acceptance of the revised Terms. Users will be notified of significant changes via email or Platform notifications.
