This Content Moderation & Takedown Policy (“Policy”) is issued by Lahar Networks Private Limited, a company incorporated under the Companies Act, 2013, bearing CIN U63112DL2025PTC452796, having its registered office at D-365, West Vinod Nagar, East Delhi, Delhi 110092, India. This Policy governs the moderation, removal, and takedown of unlawful or objectionable content posted on the Lahar platform (“Lahar” or “Platform”).
1. Purpose
1.1 The purpose of this Policy is to establish clear procedures for the removal of unlawful or objectionable content on the Platform.
1.2 This Policy ensures compliance with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Digital Personal Data Protection Act, 2023, and other applicable global laws including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).
1.3 This Policy further sets out the obligations of Lahar to respond promptly to complaints from Users, regulators, and government agencies.
2. Applicability
2.1 This Policy applies to all categories of Users, including Regular Users, Content Creators or Marketplace Operators, and Institutional Users.
2.2 Institutional Users are required to ensure that their designated Super Admins, Admins, and Users comply with the obligations under this Policy.
3. Unlawful and Objectionable Content
3.1 Unlawful or objectionable content includes but is not limited to content that is defamatory, obscene, pornographic, invasive of privacy, hateful, racially or ethnically offensive, misleading, false, fraudulent, violent, abusive, or otherwise unlawful under the laws of India or other applicable jurisdictions.
3.2 Content involving child sexual abuse material, sexual violence, terrorism, or threats to national security is strictly prohibited and shall be subject to immediate removal and reporting to competent authorities.
4. Reporting of Content
4.1 Any User may report unlawful or objectionable content through the in-platform reporting mechanism or by writing to [email protected].
4.2 Reports must contain sufficient details to allow investigation, including account identifiers, content description, and grounds for complaint.
4.3 Lahar may also receive takedown requests from government agencies, regulators, courts, or law enforcement authorities.
5. Review and Takedown Procedure
5.1 Upon receipt of a complaint or official request, Lahar shall acknowledge the complaint within twenty-four (24) hours.
5.2 Content that prima facie involves child sexual abuse material, sexual content, or nudity shall be removed or disabled within twenty-four (24) hours.
5.3 Content that violates other applicable laws, including defamation, hate speech, or misinformation, shall be reviewed and taken down within seventy-two (72) hours of receiving a valid complaint or direction.
5.4 Lahar may seek clarification or additional information from the complainant or concerned User to complete its review.
5.5 Content removals shall be documented internally and, where permissible by law, Users shall be notified of the action taken.
6. Appeals and Restoration
6.1 A User whose content has been removed may file an appeal within fifteen (15) days of notification.
6.2 Appeals shall be reviewed by a designated internal review committee within fifteen (15) business days.
6.3 Content may be restored if the review committee determines that removal was not justified under this Policy or applicable law.
7. Cooperation with Authorities
7.1 Lahar shall cooperate with law enforcement agencies, regulators, and competent authorities as required under law.
7.2 Where legally mandated, Lahar shall provide information relating to the identity, registration details, or activity logs of Users involved in the creation or circulation of unlawful content.
7.3 Cyber incidents shall be reported to CERT-In within the timelines prescribed under applicable law.
8. Transparency and Record-Keeping
8.1 Lahar shall maintain records of complaints, actions taken, and resolutions for a minimum of one hundred and eighty (180) days or longer if required under applicable law.
8.2 Lahar shall publish periodic transparency reports outlining the number of complaints received, categories of content removed, and actions taken, consistent with obligations under the IT Rules, 2021.
9. User Responsibility
9.1 Users remain solely responsible for the content they upload, post, or share on the Platform.
9.2 Users must ensure that their content complies with these Guidelines, the Terms of Service, and applicable laws.
9.3 Institutional Users shall ensure that their designated Users comply with the Maker–Checker system and do not publish unlawful or objectionable content.
10. Global Compliance
10.1 Users located outside India must comply with applicable local content laws, including GDPR, CCPA, and COPPA.
10.2 In cases where international standards differ from Indian laws, the stricter compliance requirement shall prevail, unless expressly prohibited by local law.
11. Updates to Policy
11.1 Lahar may revise this Policy periodically to reflect changes in law, regulation, or Platform operations.
11.2 Significant changes shall be communicated to Users through email or Platform notifications.
11.3 Continued use of the Platform after updates shall constitute acceptance of the revised Policy.
