This Copyright & Intellectual Property Policy (“Policy”) is issued by Lahar Networks Private Limited, a company incorporated under the Companies Act, 2013, bearing CIN U63112DL2025PTC452796, with its registered office at D-365, West Vinod Nagar, East Delhi, Delhi 110092, India. This Policy governs the ownership, protection, and enforcement of copyrights, trademarks, and other intellectual property rights on the Lahar platform (“Lahar” or “Platform”).
1. Purpose
1.1 The purpose of this Policy is to ensure that intellectual property rights are respected, that Users do not engage in unauthorized use of copyrighted or trademarked material, and that Lahar remains compliant with applicable Indian and international laws.
1.2 This Policy further provides a structured mechanism for rights holders to report violations, modeled on the Digital Millennium Copyright Act (DMCA), while ensuring fair protection for Users.
2. Applicability
2.1 This Policy applies to all categories of Users, namely Regular Users, Content Creators or Marketplace Operators, and Institutional Users.
2.2 Institutional Users must ensure that their designated Super Admins, Admins, and Users do not post or authorize content in violation of this Policy.
3. Ownership of Intellectual Property
3.1 Users retain ownership of the content they create, upload, or distribute on the Platform.
3.2 By uploading content, Users grant Lahar a limited, non-exclusive, worldwide, royalty-free license to host, display, distribute, and transmit such content solely for the operation and promotion of the Platform.
3.3 Users represent and warrant that they own or have valid licenses, permissions, or rights to the content they upload, including text, images, videos, trademarks, logos, and software code.
4. Prohibited Infringements
4.1 Users shall not upload, share, or distribute content that infringes any copyright, trademark, patent, trade secret, or other intellectual property rights of third parties.
4.2 Unauthorized reproduction, distribution, modification, or communication of copyrighted works, trademarks, logos, or proprietary material is strictly prohibited.
4.3 Users shall not misappropriate content through scraping, unauthorized downloads, or automated tools.
5. Reporting Copyright or IP Violations
5.1 Rights holders or authorized agents may report copyright or intellectual property violations by submitting a written notice to [email protected].
5.2
A valid notice must include:
a. Identification of the
copyrighted work or IP alleged to have been infringed.
b.
Identification of the content on the Platform alleged to be
infringing, with sufficient detail (such as URLs, account name, or
content description).
c. Statement by the complainant that they
have a good faith belief that the disputed use is not authorized by
the rights owner, its agent, or the law.
d. Statement by the
complainant that the information in the notice is accurate and, under
penalty of perjury, that they are authorized to act on behalf of the
rights owner.
e. Contact information of the complainant,
including name, address, and email address.
5.3 In compliance with applicable law, Lahar may share the complaint with the User who posted the allegedly infringing content.
6. Action on Receiving a Notice
6.1 Upon receiving a valid notice, Lahar shall acknowledge the complaint within twenty-four (24) hours.
6.2 Lahar may remove or disable access to the allegedly infringing content within thirty-six (36) hours, subject to applicable legal obligations.
6.3 The User who uploaded the content shall be notified of the takedown action and may submit a counter-notice if they believe the removal was in error.
7. Counter-Notice Procedure
7.1
A User whose content has been removed may submit a counter-notice to

stating that:
a. The content was removed as a result of mistake
or misidentification.
b. The User has the right to use the
content under law, license, or authorization.
c. The User
consents to jurisdiction of the courts at New Delhi, India, and
agrees to accept service of process from the complainant.
7.2 If a valid counter-notice is received, Lahar may restore the content within fifteen (15) business days, unless the complainant initiates legal proceedings.
8. Repeat Infringement Policy
8.1 Users who repeatedly infringe intellectual property rights may face suspension, termination of accounts, and forfeiture of monetization privileges.
8.2 Content Creators and Institutional Users found in violation may have revenues withheld or reversed, in line with merchant acquiring standards.
9. Protection of Lahar’s Intellectual Property
9.1 All trademarks, service marks, logos, design, code, and content created by Lahar remain the exclusive property of Lahar Networks Private Limited.
9.2 Unauthorized use, reproduction, or imitation of Lahar’s intellectual property is strictly prohibited and may lead to civil and criminal liability.
10. Global Compliance
10.1 This Policy complies with the Indian Copyright Act, 1957, the IT Act, 2000, and the IT Rules, 2021.
10.2 For international Users, this Policy aligns with the Digital Millennium Copyright Act (DMCA) in the United States, the EU Copyright Directive, and other applicable intellectual property laws.
10.3 In case of conflict between Indian law and international law, Indian law shall apply unless expressly prohibited by mandatory provisions of local law.
11. Updates to Policy
11.1 Lahar may revise this Policy periodically to reflect changes in law, regulation, or Platform operations.
11.2 Users will be notified of significant changes via email or Platform notifications. Continued use of the Platform after updates constitutes acceptance of the revised Policy.
